At least in our version. I don't know what this means. The upstream issue seems to indicate that they consider the "wrong" behaviour not to be a bug, so it's probably not surprising that it reappears with newer GHCs.

And apparently the same on 9.8-alpha4

Als 9.6.3 triggers this error.
