fix: bump cometbft to address indexer issues

This PR bumps CometBFT to v0.38.13.

This fixes issues reported by the Circle team when they were running a tx_search query over a height range.

@boojamya This also fixes the conformance / acknowledgement polling tests as Interchaintest uses the block query, which was also affected by this bug.
